The Himachal Pradesh High Court has clarified that if a recruitment process advertises positions only for the unreserved and general category, then the eligibility criteria for selection will apply solely to the unreserved category. The court stated that candidates cannot be selected for such positions based on lower marks designated for Scheduled Castes (SC), Scheduled Tribes (ST), or other reserved categories.
Justice Ajay Mohan Goyal’s court dismissed a petition while upholding the results of the new revised list issued by the university administration.
It is noteworthy that the Central University (CU) of Himachal Pradesh issued a recruitment notice for non-teaching positions in May 2017, which included two posts for Upper Division Clerk that were entirely unreserved. A petitioner from the SC category applied for these positions. The petitioner’s name was included in the first selection list released in May 2018. However, the very next day, the university suspended this list citing administrative reasons.
The revised new selection list issued on May 24, 2018, removed the petitioner’s name, and no candidate was selected for the UDC position.
